Protected Health Information (PHI) and HIPAA

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

When you use HealthyLiving.Clinic, you create a direct relationship with us as a customer. As part of that relationship, you may provide personal information such as your name, email address, phone number, and mailing address. We do not consider this type of information to be “medical” or “health” information, and it is not governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

In some cases, however, when you interact with licensed healthcare providers or pharmacies through our platform, you may provide health-related information that is subject to HIPAA or applicable state laws. HealthyLiving.Clinic is not itself a “covered entity” under HIPAA. One or more of the independent providers or pharmacy partners you interact with may be covered entities, and HealthyLiving.Clinic may serve as a “business associate” to those parties in limited capacities.

To the extent that we handle any health-related information as a business associate, we do so in compliance with applicable HIPAA regulations. Any such Protected Health Information (PHI) will only be used or disclosed in accordance with HIPAA or other applicable laws. Information that is not considered PHI may be used or disclosed in accordance with this Privacy Policy and relevant state privacy laws.

We may use or disclose PHI as permitted under HIPAA, including for:

  • Treatment: Sharing PHI with providers to coordinate care.

  • Payment: Processing payments or communicating with your health plan.

  • Healthcare Operations: Activities such as quality improvement or compliance audits.

The medical groups and providers you interact with may maintain their own separate privacy notices that describe how they handle your health information. By using our Service, you acknowledge receipt of any applicable privacy policies or notices issued by those providers or pharmacies.

Any use or disclosure of your PHI for marketing, sale, or other non-treatment purposes will only be made with your written authorization, unless otherwise permitted by law.

In limited cases, PHI may be disclosed without your authorization when required by law—for example, to report abuse, respond to legal requests, or for public health reporting. These disclosures are made in accordance with HIPAA and other laws.

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint. To file a complaint with HHS, visit: https://www.hhs.gov/hipaa/filing-a-complaint/index.html
